Acknowledgment
These are the Terms of Use governing the use of this Service and the agreement between You and the Company. These Terms of Use set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms of Use. These Terms of Use apply to all visitors, users and others who access or use the Service.
By accessing or using the Service You agree to be bound by these Terms of Use. If You disagree with any part of these Terms of Use then You may not access the Service.
You represent that you are at least 13 years of age. The Application and Digital App Services are not directed to, and the Company does not knowingly permit use by, anyone under the age of 13. If You are between 13 and 17 years of age, You represent that Your parent or legal guardian has reviewed and agreed to these Terms on Your behalf and permits You to use the Application.
Website Services - specifically, Interview Preparation Services and Checkride Preparation Services purchased as Service Packages - are available only to individuals who are at least 18 years of age. A parent or legal guardian may purchase a Service Package on behalf of a Student who is at least 13 but under 18 by completing the purchase themselves as the purchasing party. In that case the parent or legal guardian (a) accepts these Terms for themselves and on behalf of the Student, (b) is responsible for the Student's use of the Website Services and compliance with these Terms, (c) may attend any Coaching Session with the Student, and (d) consents to the collection of the Student's information as described in Our Privacy Policy, including any session recording described in the "Session Recording and Monitoring" section below.
Your access to and use of the Service is also subject to Our Privacy Policy, which describes how We collect, use, and disclose personal information. Please read Our Privacy Policy carefully before using Our Service.
Nature of the Service
Jurisdiction of the Service. The Service is designed for pilots who hold, or are training for, certificates issued by the United States Federal Aviation Administration (FAA). The Application is distributed through the United States App Store only. Regulatory features of the Service, including Ask FAR, NOTAM decoding, practice questions, medical-certificate tracking, currency and flight-review reminders, and instructor tools, address United States FAA regulations only and are not designed for, and must not be relied on by, pilots operating under the rules of any other aviation authority. Interview Preparation Services address airline hiring processes and are not specific to any regulator.
The Service consists of three separate service streams:
(a) Digital App Services provided through the Pilot92 iOS Application;
(b) Interview Preparation Services purchased and delivered online through the Website; and
(c) Checkride Preparation Services purchased and delivered online through the Website, which may include independent Coaches, AI Features, or both.
Age requirements differ by stream: the Application and Digital App Services are available to Users 13 and older, while Website Services (Service Packages) require the purchasing party and Student to be at least 18, except where a parent or legal guardian purchases on behalf of a minor Student who is at least 13 as described in the Acknowledgment section above.
Pilot92 subscriptions and other paid digital functionality used within the Application are separate from the Website Services. Interview Preparation Services and Checkride Preparation Services are purchased through the Website and do not provide or unlock paid functionality within the Pilot92 Application.
The Company provides the Application and the technology used to advertise, arrange, schedule, and process payment for Website Services. Unless expressly stated otherwise, the Company is not the provider of Coaching Services. Each Coach is independently responsible for the content, method, professional judgment, and performance of the Coaching Services that Coach provides.
Each Coach has entered into a separate written agreement with the Company that governs the Coach's qualifications, conduct, confidentiality, privacy and data-handling obligations, and non-circumvention obligations. That agreement governs the relationship between the Company and the Coach; these Terms govern Your relationship with the Company.
Session Recording and Monitoring
Coaching Services are delivered by live video conference through Google Meet or another platform the Company designates. The Company may, with notice displayed before or at the start of the session, record, transcribe, or generate automated notes or summaries of a Coaching Session for quality assurance, customer support, dispute resolution, Coach training and evaluation, and safety. By joining a session that displays a recording or transcription notice, You consent to that recording and to the processing of the recording as described in Our Privacy Policy. If You do not consent, You must say so before the session begins and We will either conduct the session without recording or reschedule it; a session will not be treated as a missed or used session because You declined to be recorded. Company personnel may also join, observe, or review a session for the same purposes. You may not record, screen-capture, transcribe, or use automated notetaking tools during a Coaching Session without the Company's and the Coach's prior written consent. Recordings and transcripts are the Company's property, are retained only as described in Our Privacy Policy, will not be published, and will not be voluntarily shared with any airline or employer; they may be disclosed to third parties only as described in the "Legal Process" section below.
The Company is not an airline, air carrier, flight school, designated pilot examiner, employment agency, recruiting agency, or governmental authority. The Service is not sponsored, approved, or endorsed by the Federal Aviation Administration or any airline unless expressly stated otherwise in writing.
Website Service Packages, Purchases and Bookings
Service Packages are fixed-price services, not physical goods. The description presented at checkout identifies the sessions, materials, AI Features, evaluations, or other benefits included in a particular Service Package.
By completing a Purchase, You represent that You are legally capable of entering into a binding agreement and that the account, contact, and payment information You provide is accurate and complete.
Service Packages are personal to the purchasing Student and may not be transferred, resold, or shared without the Company's prior written permission. Unless otherwise stated at checkout, unused Coaching Services included in a Service Package expire 60 days after purchase.
Organizational Purchases. A flight school, training organization, airline, or other employer (an "Organization") may purchase Service Packages on behalf of one or more named Students. In that case the Organization is the purchasing party and accepts these Terms for itself and on behalf of each designated Student; each designated Student must also accept these Terms when creating an Account; the Service Package remains personal to the designated Student and may not be reassigned to another individual without the Company's prior written permission; refunds, if any, are paid to the Organization; and the Organization is not entitled to a Student's session recordings, evaluations, or session summaries unless the Student has consented in writing and the Company agrees. Organizations may contact the Company to arrange multi-Student purchases.
A Purchase does not guarantee the availability of a particular Coach, date, or time until a Booking has been confirmed. The Company may correct pricing or description errors and may reject or cancel a Purchase involving suspected fraud, unauthorized activity, an obvious pricing error, or unavailable services. If the Company cancels a paid Purchase for one of these reasons and the Student is not responsible for the cancellation, the affected amount will be refunded.
Website Payments
Purchases of Interview Preparation Services and Checkride Preparation Services are processed through Stripe or another Payment Processor designated by the Company.
Payment information is submitted directly to the Payment Processor. The Company does not store complete payment-card numbers on its own servers.
Prices, applicable taxes, platform fees, and other mandatory charges will be disclosed before checkout. By completing a Purchase, You authorize the Payment Processor to charge the selected payment method for the amount displayed.
Payments for Website Services are separate from Pilot92 In-App Purchases. Purchasing a Website Service Package does not provide or unlock paid functionality within the Pilot92 Application.
Coaching Cancellations and Refunds
A Student may request a full refund of a Service Package within 7 days of the purchase date, provided no session included in that Service Package has been used or attended. This refund window is unavailable once any session in the Service Package has been booked and completed or is otherwise treated as used under this section. Refund requests are reviewed by the Company on a case-by-case basis and are not automatically processed at checkout.
A Student may cancel or reschedule a Booking without a cancellation charge by providing at least 24 hours' notice before the scheduled start time.
A Booking cancelled less than 24 hours before its scheduled start time, or missed without notice, is nonrefundable and may be treated as a used session of the applicable Service Package.
If a Coach cancels a Booking, the Student may choose a reasonable rescheduled time or receive a refund for the affected session.
A Student who arrives late is entitled only to the remaining scheduled time unless the Coach agrees otherwise. The Coach is not required to extend the session.
Refunds for Pilot92 Subscriptions and In-App Purchases are governed separately by Apple's applicable refund policies. Nothing in this section limits any refund right that applicable consumer-protection law grants and that cannot be waived by contract.
Pilot92 Subscriptions and In-app Purchases
Paid Digital App Services, including Pilot92 subscriptions and digital functionality purchased or unlocked within the Application, are processed through Apple's In-App Purchase system.
Pilot92 subscriptions are billed in advance on the recurring period displayed before purchase and automatically renew unless cancelled through the User's Apple account before the applicable renewal date.
Users may manage or cancel subscriptions through their Apple account or device subscription settings. Cancellation stops future renewal but ordinarily does not provide a refund for the current subscription period.
Apple's applicable billing, cancellation, and refund policies govern In-App Purchases. Refund requests for In-App Purchases must be submitted to Apple except where applicable law requires otherwise.
The Company may use RevenueCat or another entitlement-management provider to validate purchases and manage access to paid Digital App Services. RevenueCat does not independently charge the User's payment card; Apple processes the In-App Purchase.
Website Service Packages are not In-App Purchases and do not unlock Digital App Services within Pilot92.
Coaches (Independent Contractors)
Independent Coaches
Coaches provide Coaching Services as independent contractors operating their own independent businesses. Coaches are not employees, agents, representatives, partners, franchisees, or joint venturers of the Company and have no authority to make representations, warranties, commitments, or agreements on behalf of the Company.
Subject to the standards required for participation in the marketplace, each Coach independently determines whether to accept a Booking and is responsible for the manner and means used to perform Coaching Services.
Coaches are responsible for their own taxes, insurance, equipment, business expenses, qualifications, licenses, certificates, and compliance with applicable law.
Nothing in these Terms creates an employment relationship between the Company and a Coach.
Coach Qualifications and Conduct
Before a Coach is listed, the Company verifies the Coach's FAA certificate against the FAA Airmen Registry (or the professional credential applicable to the Coach's role), reviews the Coach's résumé and references, confirms the Coach's airline or industry employment, and conducts a video interview, and may in addition obtain a background screening through a consumer reporting agency. The Company re-verifies advertised credentials at least annually while a Coach remains listed. Any review is based only on information available at the time and is not a guarantee of the Coach's identity, competence, honesty, safety, future conduct, or suitability for a particular Student.
A background screening is not obtained for every Coach; unless a Coach's profile expressly states that a background screening was completed, Users should not assume that one was.
Students remain responsible for exercising reasonable judgment when communicating and working with Coaches online. To the maximum extent permitted by law, the Company is not responsible for a Coach's independent acts, omissions, statements, misrepresentations, fraud, misconduct, negligence, or violation of law.
Nothing in this section excludes liability that cannot legally be excluded or liability arising from the Company's own gross negligence, willful misconduct, or fraud.
Interview Preparation Services
Interview Preparation Services are educational coaching services only. They are not recruiting services, an offer of employment, or a representation made by an airline or prospective employer.
Neither the Company nor any Coach guarantees that a Student will receive an interview, pass an interview, receive a job offer, complete employer training, retain employment, obtain a particular seniority position, or achieve any particular compensation or career outcome.
Coach statements concerning airline hiring practices, interview questions, selection standards, or employment conditions may be based on personal experience and may be incomplete, subjective, or outdated. Students must independently verify material information with the applicable prospective employer.
Users may not request, disclose, upload, record, sell, or distribute confidential, proprietary, unlawfully obtained, or restricted interview materials belonging to an airline, employer, or other third party.
Interview and checkride preparation may involve practicing answers to questions about medical certification, medical conditions, medications, alcohol or substance use, disciplinary or legal history, military service, and similar matters. You decide what to share; You are not required to disclose any such information to a Coach, and anything You do disclose is used only to deliver Your session, is not voluntarily shared with any airline or employer, may be disclosed to third parties only as described in the "Legal Process" section, and is handled as described in Our Privacy Policy. You may ask that a session in which You expect to discuss such matters not be recorded. You must not disclose to a Coach or through the Service any classified, export-controlled, or otherwise legally restricted information from military, government, or prior employment; the Company and its Coaches are not authorized to receive it and cannot protect it.
Checkride Preparation Services
Checkride Preparation Services are provided solely for educational and practice purposes. They are not an FAA practical test, official FAA instruction, an examiner's determination, an authorization to operate an aircraft, or a guarantee that a Student will pass a knowledge test, practical test, proficiency check, checkride, certificate, or rating.
The Company does not issue flight-instructor endorsements or determine whether a Student is eligible or prepared for a practical test. Unless separately and expressly arranged with a properly qualified instructor, Coaching Services do not constitute flight instruction.
Students are responsible for consulting current FAA regulations, the applicable Airman Certification Standards or Practical Test Standards, official FAA publications, and qualified aviation professionals. Students remain responsible for all eligibility, training, experience, endorsement, and testing requirements.
Artificial Intelligence Features
AI Features that answer regulatory questions are scoped to the United States Federal Aviation Regulations and generate responses by reference to the Electronic Code of Federal Regulations (eCFR) as processed by a third-party AI model; they do not query FAA operational systems, and citations should be checked against the current eCFR text. AI Features may produce information that is inaccurate, incomplete, misleading, outdated, or inappropriate for a particular situation. AI outputs are generated automatically and are not independently verified for every User or use.
AI Features are not a substitute for a qualified flight instructor, designated pilot examiner, airline representative, official FAA publication, current regulation, or the User's professional judgment.
Users must independently verify all material AI-generated information. AI Features must not be used as the sole basis for flight planning, weather decisions, aircraft operation, emergency procedures, regulatory compliance, or other safety-critical decisions. You acknowledge that AI Features are provided for practice and study only and that You assume all risk of relying on them.
No AI-generated score, assessment, recommendation, or statement guarantees readiness for a checkride, certificate, rating, interview, or employment opportunity.
Pilot92 Logbook and Briefing Tools
Pilot92 logbook tools are organizational aids. Users are solely responsible for the accuracy, completeness, retention, backup, and regulatory sufficiency of their flight records.
Pilot92 briefing and weather-related tools are supplemental informational aids. They may not contain every item necessary for a complete preflight evaluation and must not be treated as the sole source of weather, NOTAM, airspace, airport, aircraft-performance, or operational information.
The pilot in command remains responsible for consulting current authoritative sources, obtaining and evaluating all required information, and complying with applicable regulations. Pilot92 briefing and weather tools are not an official weather briefing, are not a substitute for a briefing obtained from an FAA-approved source (such as Flight Service or an approved flight-planning provider), and do not satisfy the preflight-action requirements of 14 C.F.R. § 91.103.
Promotions
Any Promotions made available through the Service may be governed by rules that are separate from these Terms.
If You participate in any Promotions, please review the applicable rules as well as Our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.
The Company is the sole sponsor of any Promotion offered through the Application. Apple Inc. is not a sponsor of, and is not involved in any way with, any Promotion. The official rules of each Promotion, including eligibility, entry, judging, prizes, and winner selection, will be made available within the Application before You enter. No purchase is necessary to enter or win any Promotion unless the official rules expressly state otherwise. Quizzes, challenges, and leaderboards that award no prize and are open to all Users on the same basis are features of the Service, not Promotions, and are governed by these Terms alone.

Content Restrictions
The Company is not responsible for the content of the Service's users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under Your Account, whether done so by You or any third person using Your Account.
You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:
- Unlawful or promoting unlawful activity.
- Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.

- Impersonating any person or entity including the Company and its employees or representatives.
- Violating the privacy of any third person.
- False information and features.
The Company reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with these Terms, refuse or remove this Content. The Company further reserves the right to make formatting and edits and change the manner of any Content. The Company can also limit or revoke the use of the Service if You post such objectionable Content. As the Company cannot control all content posted by users and/or third parties on the Service, you agree to use the Service at your own risk. Content Backups
Although regular backups of Content are performed, the Company does not guarantee there will be no loss or corruption of data.
Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.
The Company will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But You acknowledge that the Company has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.
You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.

You can contact our copyright agent via email at info@pilot92.com. Upon receipt of a notification, the Company will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Service.

The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of the Company and its licensors.
The Service is protected by copyright, trademark, and other laws of both the Country/State and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.
Your Feedback to Us
You assign all rights, title and interest in any Feedback You provide the Company. If for any reason such assignment is ineffective, You agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.
Links to Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by the Company.
The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.
We strongly advise You to read the terms and conditions and privacy policies of any third-party websites or services that You visit.
Links from a Third-Party Social Media Service
The Service may display, include, make available, or link to content or services provided by a Third-Party Social Media Service. A Third-Party Social Media Service is not owned or controlled by the Company, and the Company does not endorse or assume responsibility for any Third-Party Social Media Service.
You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with Your access to or use of any Third-Party Social Media Service, including any content, goods, or services made available through them. Your use of any Third-Party Social Media Service is governed by that Third-Party Social Media Service's terms and privacy policies.
Termination & Non-Circumvention
Termination
We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms of Use.
Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.
If We terminate Your Account without cause (and not because of Your breach of these Terms), We will (a) refund, on a pro-rata basis, any sessions in a paid Service Package that have not been used as of the effective date of termination, and (b) for a Pilot92 Subscription purchased through Apple, direct You to Apple, which handles refunds for In-App Purchases under its own policies. Termination does not relieve You of any fees owed for the period before termination. You may close Your Account at any time in the Application (Profile → Account → Delete Account) or from Your Website dashboard, as described in Our Privacy Policy.
Non-Circumvention
All scheduling, messaging, and session communications between Students and Coaches take place through the Website, the Company's scheduling and messaging systems, and the video-conference link the Company issues for each Booking. The Company does not provide a Coach's personal contact details to Students, and Students may not ask a Coach for them, contact a Coach outside a scheduled session, or contact a Coach after the purchased service is completed. Neither a Student nor a Coach may use an introduction, contact information, or relationship obtained through the Website to avoid the Company's payment process or platform fees.
For 12 months after the most recent Booking between a Student and Coach, neither party may directly or indirectly request, offer, arrange, make, accept, or facilitate an off-platform payment for substantially similar services between those parties if they were first introduced through the Website. This restriction applies only to the extent permitted by applicable law. As applied to a Coach, it is also subject to the Coach's separate written agreement with the Company, which may limit the restriction where the law of the Coach's state so requires.
This restriction does not apply to a bona fide relationship that existed before the parties were introduced through the Website and was disclosed to the Company before their first Booking.
Violations may result in cancellation of Bookings, suspension or permanent termination of Accounts, loss of promotions or platform benefits, and recovery of documented platform fees that otherwise would have been payable, to the extent permitted by law.
Student Conduct Toward Coaches
Coaches provide candid professional evaluations, and an evaluation, score, or recommendation that a Student disagrees with is not a ground for complaint against the Coach personally. Students must treat Coaches with courtesy and must not harass, threaten, intimidate, stalk, or retaliate against a Coach, contact a Coach outside the Website, post about a Coach publicly, or attempt to identify or locate a Coach outside the Service. A Coach may end a session in which a Student behaves abusively, and that session will be treated as a used session. The Company may suspend or terminate the Account of a Student who violates this section without refund of used or forfeited sessions, and may report threatening conduct to law enforcement. Concerns about a Coach or an evaluation should be raised with the Company through the "Contact Us" section, and the Company will review them.
Legal Process
The Company does not voluntarily disclose Your Account information, session recordings, transcripts, notes, evaluations, scorecards, session summaries, or communications to any airline, employer, or other third party. The Company may, however, disclose such information where required by a subpoena, court order, discovery request, or other lawful process, or by a lawful request of a governmental or regulatory authority, including the Federal Aviation Administration or the National Transportation Safety Board. Where the law permits and it is practicable, the Company will notify You of the request before responding so that You may seek to limit or quash it, and the Company may, but is not obliged to, object to a request it considers overbroad. Nothing in these Terms requires the Company to withhold information from a person lawfully entitled to it.

But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law
The laws of the Country/State, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.
Dispute Resolution
Informal Resolution. If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by sending a written notice to the Company at the email or postal address in the "Contact Us" section describing the dispute and the relief You seek. The Company will do the same if it has a dispute with You. The parties will attempt in good faith to resolve the dispute for at least sixty (60) days after the notice is received before starting a court proceeding. Any applicable limitations period is tolled during this sixty-day period. Nothing in this section prevents either party from seeking emergency injunctive relief, from bringing a claim in small claims court, or from reporting a concern to a government agency.
Venue; Jury Waiver. Subject to applicable law that cannot be waived by contract, You and the Company agree to the exclusive jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona, for any dispute arising out of or relating to these Terms or the Service, and waive any objection to that venue. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND THE COMPANY EACH WAIVE ANY RIGHT TO A JURY TRIAL in any such proceeding.
Limitation Period. To the extent permitted by applicable law, any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose, or it is permanently barred.
